The rules that make it legal
PECR governs live marketing calls: screen against the TPS and the corporate TPS, respect any do-not-call request a person makes directly, present your number, and say who you are. The ICO enforces it and fines are routine for firms that dial unscreened lists. None of this bans the craft; it bans doing it to people who said no.
Where cold calling is actually banned
Pension cold calls have been banned since 2019, and claims-management calls need FCA authorisation and consent. Sector rules move, which is one reason campaign scripts here are approved per campaign: what is sellable by phone depends on what is being sold.
What this means for a seller
Personal liability for list hygiene is the brand’s and the platform’s problem, not yours: numbers are screened before the dialer connects and calls are recorded. What remains yours is conduct on the call, honesty about who you are and what you are selling, and taking a no as a no. That standard is also just what closing well looks like.
